Digital and the Crisis of Trust: The Overlooked Urgency of Personal Data Protection

This research focusses on the urgent need for legal protection of the confidentiality of personal data for banking consumers. This research is normative legal research that employs a conceptual and statutory approach. The investigation implements prescriptive legal analysis. The research results suggest that legal protection is essential in the face of the high risk of data misuse by negligent parties and the rapid advancement of information technology. Customers' confidential data, including financial information and identity, is sensitive and susceptible to data breaches, fraud, and identity theft. Consequently, to preserve customer confidence, prevent financial losses, guarantee that banks adhere to relevant regulations, and establish a secure and dependable banking environment, it is imperative to establish robust legal protection. Administrative, civil, and criminal obligations pertain to client personal data confidentiality. To prevent violations, banks are required to adhere to data protection regulations established by supervisory authorities. In civil law, banks are obligated to ensure the confidentiality of data and to provide compensation in the event of a leak or misuse that adversely affects the consumer. To comprehensively safeguard the rights and interests of customers, data confidentiality violations that are the result of negligence or intentional actions may be subject to legal sanctions, including imprisonment or fines.
